In Spain, there are certain cases where a non-EU national can obtain a temporary residence authorization with work permit exemption. This legal option, often overlooked, is designed for specific professional or academic activities that fall under the categories set by Spanish immigration law.
At ARC Legal, we explain in simple terms what this authorization is, who it applies to, and what you should know if you’re planning to move to Spain under this scheme.
⏺️ What is the temporary residence authorization with work permit exemption?
It’s a type of residence that allows foreign nationals to live legally in Spain while carrying out a specific activity (such as academic, scientific, religious, or journalistic work), without the need to obtain a work permit — as long as the planned activity exceeds 90 days.
Please note that this is not a general work visa and only applies to a limited number of circumstances defined by law.
⏺️ Who can apply?
Spanish regulations recognize several categories of foreign nationals who do not require a work permit:
- Technicians, researchers or scientists invited or hired by the Spanish State, Autonomous Communities, universities, or public research entities.
- Professors, researchers or experts hired by Spanish universities.
- Directors, teachers or researchers from foreign cultural or educational institutions officially recognized in Spain.
- Civilian or military officials from foreign governments participating in cooperation programs with a Spanish administration.
- Foreign journalists or correspondents, officially accredited by Spanish authorities.
- Members of international scientific missions, authorized by Spanish authorities.
- Religious ministers or members of religious orders, as long as their activities are strictly religious or contemplative.
- Representatives of international trade unions or employers’ associations, in the exercise of their official duties.
- Workers posted to Spain by companies established in another EU country under transnational service agreements.
In all cases, the person must provide proof of the activity to be carried out and justify that it fits within one of the above categories.
💡 At ARC Legal Abogados, we help you correctly identify which exemption applies to your case, prepare the necessary documentation, and clearly demonstrate your professional profile to the Spanish authorities. Every detail matters — and we make sure nothing is overlooked.
⏺️ What are the requirements?
In addition to belonging to one of the recognized categories, applicants must meet a series of personal and documentary requirements to be eligible for this residence authorization.
These requirements are similar to other immigration processes in Spain and are intended to ensure that the applicant is in good standing. If you’re unsure about any of them, we’ll review everything with you step by step.
Key requirements include:
- Not being in an irregular situation in Spain. Applications must be submitted from your country of origin or legal residence.
- No criminal record, either in Spain or in countries where you’ve resided in the last five years.
- Valid passport, with at least one year of remaining validity.
- Medical certificate, confirming that you do not suffer from any condition considered a public health risk under international regulations.
- Legalized or apostilled foreign documents. All documents not issued in Spain must be properly legalized or apostilled, and officially translated into Spanish if necessary.
- Payment of administrative fees, once the application is formally accepted for processing.
⏺️ How do I apply?
Applications must be submitted at the Spanish Consulate or Embassy in your country of residence, before arriving in Spain. Once your visa is granted, you’ll need to enter Spain and, if your stay is longer than six months, apply for a foreigner identity card (TIE).
⏺️ How long does this residence authorization last?
The duration of this residence permit depends on the length of the activity to be carried out in Spain. In most cases, it is granted for up to one year, but it can be renewed if the same conditions still apply.
⏺️ Need help with your application?
At ARC Legal we support you throughout the entire process — from assessing your case to preparing documents, submitting your application, and taking care of your arrival in Spain. We can assist with your TIE appointment, local registration (empadronamiento), and even opening a bank account.
