Since the entry into force of the new Spanish Immigration Regulation (Royal Decree 1155/2024) on May 20th, 2025, many doubts have arisen—among foreign nationals and legal professionals alike—about how its provisions apply to applications that were submitted under the previous regulation.

On June 20th, 2025, the General Directorate for Migration Management (DGGM) issued an official note clarifying an important point: if you submitted your application before May 20th, 2025 (when the previous regulation still applied), but you formally requested to apply the new Immigration Regulation, you may obtain a Spanish Social Security Number (NUSS) and register to work—only if the new residence or stay permit granted to you includes the right to work.

In other words, even if your original application did not allow you to work (as per the old regulation), if you requested to apply the new rules and received a permit that includes work rights, then you are entitled to register with the Spanish Social Security system and start working legally, just like any other person authorized to work in Spain.

This clarification is crucial for ensuring legal certainty and full inclusion for those who have made use of this transitional provision established by the legislator. It will have a direct impact on many applications submitted before May 2025 who are now allowed to work under the new framework.
