Published GECCO 2026 Order: key aspects of collective hiring at origin for companies

The Spanish Official State Gazette (BOE) has published Order ISM/1547/2025, which regulates the Collective Management of Hiring at Origin (GECCO) for 2026. This mechanism is a key tool for Spanish companies to hire foreign workers who are not present in Spain, particularly in sectors with seasonal or structural labour shortages.

The regulation, approved by the Ministry of Inclusion, Social Security and Migration, will be in force from 1 January to 31 December 2026, with the possibility of a six-month review depending on labour market developments.

⏺️ What does the GECCO 2026 Order regulate?

The Order establishes the legal and procedural framework for:

– Collective hiring at origin of foreign workers.
– Named or generic job offers, both for permanent and seasonal activities.
– Official application forms, annexes and commitments required from companies and business organisations.
– Workers’ rights and guarantees, including accommodation, travel and return arrangements.
– The return commitment, particularly relevant in circular migration projects.

⏺️ Key aspects to consider

From a practical perspective, the Order reinforces several elements that companies should keep firmly in mind:

– The need for advance planning by employers.
– The correct identification of working conditions, accommodation and costs assumed.
– The use of updated official forms, as incorrect completion may lead to delays or refusals.
– The importance of complying with deadlines and return commitments, especially in seasonal hiring.
