Following the entry into force of the new Immigration Regulation (Royal Decree 1155/2024), at ARC Legal Abogados we have started receiving decisions for international students whose renewal applications for student stay permits were filed under this new regulation.
One of the most positive developments we have observed is that the duration of the permit is now granted for the entire length of the studies, as long as they are higher education studies, pursuant to Article 55 of the Regulation. This means that if the degree program lasts four years, the authorization will be granted for a four-year period.
⏺️ From annual renewals to a single authorization
Until now, students had to renew their authorization every year. This meant demonstrating sufficient academic performance and submitting documents again, such as health insurance and proof of financial means. Under the new regulation, if a student is enrolled in a four-year university degree, the authorization can now be granted directly for the same period, until the official completion of the studies.
Instead of undergoing a full renewal process, the student will only be required to notify the Immigration Office that they have made satisfactory academic progress. It remains to be seen how Immigration Offices will request this documentation, but in any case it will be a much simpler process than the former annual renewal.
Below, we share a recent decision we handled where it is clearly stated that the authorization is granted until the official completion of the studies:
In addition, the foreign identity card (TIE) remains valid until the expiration of the authorization, which means there is no need to renew it every academic year.
⏺️ A direct benefit for students
This development provides significant relief to international students, allowing them to focus on what really matters: their studies. Fewer procedures mean fewer associated costs and less uncertainty, which ultimately also benefits universities and educational institutions hosting these students.
