Administrative Fees in Spain’s Extraordinary Regularization

The recent regulation of the extraordinary regularization process in Spain not only establishes substantive requirements to obtain a residence permit, but also includes an essential formal obligation: the payment of the corresponding administrative fee.

In this article, we break down what this requirement involves, the legal framework behind it, and the key practical aspects you should consider.

⏺️ Is it mandatory to pay an administrative fee?

Yes. One of the explicit requirements to process a residence permit under exceptional circumstances —within the framework of the extraordinary regularization— is: Payment of the administrative processing fee.

Although this is a formal requirement, it is a critical one. Failure to pay the fee may lead to the inadmissibility or suspension of the application, so it must be handled correctly from the outset.

⏺️ Which regulation governs this fee?

The amount of the fee is not directly established in the Royal Decree regulating the extraordinary regularization. Instead, it refers to a specific regulation: Order PJC/617/2025, of June 13.

This Order sets out the fees applicable to:

  • Administrative authorizations in immigration matters
  • Identity documents for foreign nationals

⏺️ Which form must be used?

The fee must be paid using: Modelo 790, código 052

This is the standard form used for processing residence authorizations in Spain.

⏺️ What is the applicable fee?

For this procedure, the applicable fee corresponds to: Temporary residence authorization under exceptional circumstances (arraigo). The amount is established by Order PJC/617/2025 and currently stands at: 38,28€
